Both myself and friends signed up for this last year and paid our money for a poosible upgrade,we both knew there was a small fee if unsuccessful as it was in the details.We had a one way trip to bangkok and our friends had a return trip to bangkok a couple of weeks after we departed,we were unsuccessful in getting an upgrade and our friends got one on the outbound leg but not on the return leg and we both recieved our money back with a couple of weeks and the fee was I believe $5 each.
So to me yes they have your money,for how long depends on when exactly you sign up for a possible upgrade,and the $5 fee was more than acceptable to us,just think of it as buying a raffle ticket.
