It is all about how the movies are copied but absolutely nothing to do with the digital storage. Different copying formats are used indiscriminately with pirated dvds but once again has nothing to do with the storage medium and does not affect the subtitling but simply copies what is already there. So, if they are using a professional original there will be useable subtitles but if it is a copy of a recording in a cinema...
If this is a bit too technical for you, maybe that teenager in charge of your remote can explain it better.
