According to police the first assault was made by the person who died and then situation deteriorated. This is from Jakarta Post earlier this week

Three suspects named after death of New Zealand tourist

The Bali Police named three suspects allegedly involved in a recent brawl, which led to the death of a New Zealand tourist, at a bar on Jl. Legian in Kuta, Badung regency.

Denpasar Police Chief Sr. Comr. Alit Widana told reporters the brawl had erupted after the victim, Keith William Headifen, fought with a bartender at New Bounty Ship Bar, Restaurant and Discotheque on Sunday at 1 a.m..

He said Headifen, who was drunk, got angry and threw his glass at I Nengah Mustika, the bartender who refused to exchange his ticket for a drink.

The bartender threw a pitcher that hit the victim's right temple before Nani Aplonius Epson Tafui, a.k.a Doni, a security guard, tried to forcibly remove the victim from the bar.

"When the victim resisted the security guard, Andreas Seran, another guest, beat the victim," Alit said.

He said the victim's wife, Sarah Marie Whitburn, brought him back to their hotel, Sari Yasa Samudra, which is also located on Jl. Legian.

A hotel employee reportedly called an international hospital but Whitburn refused to take her husband there after learning it would cost Rp 3 million (US$265), which was too costly for her.

At around 6 a.m., she came to the hotel's office, saying her husband's breathing had weakened. But a doctor, who later came to check on the victim's condition, said he had died about an hour earlier.

The autopsy at Sanglah General Hospital revealed Headifen had died of blunt force trauma.

"The victim suffered from bruises on his lips, left and right temples, as well as on the back of his head. But it was the trauma to his right temple that caused his death," the coordinator of the forensic department at Sanglah General Hospital, Dudut Rustyadi, said Monday.

"The inner bleeding in the right temple disturbed the brain and the respiratory function," he said, adding his forensic team had not found cut wounds on the victim's body.

The police charged Mustika, the bartender, with violating the Criminal Code Article 351 on torture, which carries a maximum sentence of seven years in prison.

Doni and Andreas were charged with violating Article 170 for committing violence together. If proven guilty, they could face a maximum sentence of 12 years in prison.

Meanwhile, the discotheque's operation manager, Tri Yudo Inahyo, admitted two of his employees and a guest had been named suspects.
