I was told (in 1996) that hawkers were forbidden to go below the high water mark, unless they were specifically invited. It was suggested that hawkers would aim to gain your attention from above the high water mark, and take that as an invitation to approach.
The people that told me this were an American couple (older travellers) with whom we shared a meal in Ubud, prior to going to Kuta. We found the hawkers at Sengiggi (Lombok) and in the Gili's to be rather more laid back, but still insistent - the high water mark rule obviously didn't apply in these places.
